Terms and Conditions Rosarelia

Article 1 – Definitions

In these terms and conditions, the following terms shall mean:

Rosarelia: the business selling jewelry and accessories under the trade name Rosarelia via its webshop and any other sales channels.

Customer: any natural person or legal entity placing an order, entering into an agreement with Rosarelia, or using the services of Rosarelia.

Consumer: a natural person who is not acting for purposes relating to his or her trade or business.

Agreement: the agreement between Rosarelia and the customer concluded after an order has been confirmed by Rosarelia.

Order: an order placed by the customer for one or more products via the webshop or any other sales channel offered by Rosarelia.

Product: any item offered by Rosarelia, including costume jewelry, earrings, accessories, and personalized jewelry.

Costume jewelry: jewelry that is not made of solid gold, silver, or other precious metals, unless explicitly stated otherwise for the product in question. The materials used and any coatings are, where relevant, stated with the product in question.

Personalized product: a product that is adapted or manufactured at the customer's request, for example, by adding a name, text, date, initials, or other personal data or choices of the customer.

Cooling-off period: the statutory period within which a consumer can exercise their right of withdrawal.

Right of withdrawal: the statutory right of a consumer to withdraw from the agreement within the applicable period without giving any reason.

Durable medium: any tool that allows information addressed personally to the customer to be stored in a way that allows for future consultation in an unchanged form, such as e-mail.

In writing: this also includes communication via e-mail, unless the nature of the provision dictates otherwise.

Terms and Conditions: these terms and conditions of Rosarelia.

Article 3 – Applicability

These terms and conditions apply to all offers from Rosarelia, to every order, and to every agreement between Rosarelia and the customer.

The terms and conditions are made available before or during the placing of an order in such a way that the customer can view them and, if desired, save them.

By placing an order, the customer declares that they have taken note of these terms and conditions.

When additional conditions apply alongside these terms and conditions, this will be stated clearly with the relevant product or service.

If any provision of these terms and conditions proves to be void or is annulled by a court, the remaining provisions shall remain in full force. In such a case, Rosarelia and the customer shall attempt to replace the relevant provision with a legally valid provision that is as close as possible to the original intention.

When a situation arises that is not expressly provided for in these terms and conditions, it shall be assessed on the basis of applicable law and regulations and the scope of these terms and conditions.

When a provision is capable of several interpretations, it shall be interpreted in accordance with applicable law and regulations. In consumer agreements, the legal rule also applies that ambiguous clauses are, in principle, interpreted in favor of the consumer.


Article 4 – The offer

Rosarelia makes its utmost effort to describe its products as completely, correctly, and accurately as possible.

For every product, as far as relevant, information is provided about, among other things:

  • the most important characteristics;

  • the materials used;

  • dimensions;

  • color;

  • any coating or finish;

  • any particulars regarding use and maintenance;

  • the price;

  • availability;

  • and, if applicable, the options for personalization.

Rosarelia primarily sells costume jewelry. The customer can see from the product information what materials a specific product is made of.

A product is not offered as solid precious metal unless this is explicitly and correctly stated with the product.

Images are displayed as accurately as possible. Because the display of colors can vary by screen, Rosarelia cannot guarantee that the color on the screen corresponds exactly to the actual color of the product.

Obvious mistakes, clerical or price errors in a product are not binding.

When an offer has a limited period of validity or is subject to certain conditions, this is clearly stated with the offer.

The information with a product is intended to give the customer sufficient information to make a well-informed purchase decision.


Article 5 – Personalized jewelry

In addition to standard products, Rosarelia also offers personalized jewelry.

For a personalized product, the customer can, for example, provide a name, text, date, initials, letter, image, or other personal choice, insofar as this option is offered with the product in question.

The customer is responsible for correctly providing the information necessary for the personalization.

Rosarelia is not responsible for errors in a personalization that are the result of incorrect, incomplete, or misspelled information provided by the customer.

Rosarelia cannot always change an order with a personalized product once production or personalization has started.

Personalized products may fall under the statutory exception to the right of withdrawal when the product is made according to the consumer's specifications or is clearly personal in nature.

Rosarelia will clearly indicate with the product, before the order is placed, when the right of withdrawal is excluded for a personalized product.

A personalized product that falls under a statutory exception cannot be returned on the basis of the right of withdrawal. The consumer's legal rights regarding a defective or faulty product remain fully applicable.


Article 6 – Conclusion of the agreement

The agreement is concluded as soon as the customer has placed the order via the webshop and Rosarelia has confirmed the order, unless Rosarelia cannot or does not wish to accept the order.

After placing an order, the customer will receive an electronic order confirmation as soon as possible.

The confirmation will contain at least the essential details of the order, including the ordered products, any personalization, price, and the delivery address.

Rosarelia may refuse an order or impose additional conditions if there is a reasonable justification for doing so, within the limits of the law.

An order is processed subject to the availability of the products in question.

If an ordered product unexpectedly turns out to be unavailable, Rosarelia will inform the customer as soon as possible. If the agreement cannot be fulfilled as a result, any amount already paid will be refunded in accordance with legal regulations.


Article 7 – Prices and payments

All prices listed for products are the prices displayed during the ordering process.

Rosarelia uses the Small Businesses Scheme (KOR). To the extent that the KOR applies, no VAT is charged separately to the customer.

The listed prices are the prices displayed with the product at the time of ordering. Any shipping costs and other additional costs are clearly displayed before finalizing the order.

The customer must pay the due amount via one of the payment methods made available during the ordering process.

An order is processed, where applicable, after the payment has been successfully received or the chosen payment method has confirmed the payment.

The customer is responsible for providing correct payment and contact details.

When the customer uses a payment method where payment occurs afterwards via an external payment service, the customer is personally responsible for fulfilling payment obligations to that payment service in a timely manner.

Rosarelia is not responsible for any costs, interest, or payment reminders imposed on the customer by an external payment service due to late payment, insofar as these costs result from the customer's actions or omissions.


Article 8 – Delivery and shipping

Rosarelia aims to ship orders within 1 to 3 working days after receipt of the order. The actual shipping period may depend on product availability and, for personalized products, the time required to personalize the product.

The order is delivered to the address provided by the customer during the ordering process. The customer is responsible for correctly entering the delivery address. Rosarelia is not responsible for delays or issues resulting solely from an incorrectly provided delivery address.

The mentioned shipping term of 1 to 3 working days refers to the period within which Rosarelia expects to ship the order. Final delivery time may also depend on the carrier. If an order is delayed, Rosarelia will inform the customer as soon as reasonably possible.

The risk of damage or loss of a product rests with Rosarelia until the moment of delivery to the consumer or a third party designated by the consumer, unless the law provides otherwise.


Article 9 – Right of withdrawal

9.1 Right of withdrawal for consumers

In principle, a consumer has the right to withdraw from the agreement within 14 days without giving any reason in the event of an online purchase.

The reflection period begins the day after the consumer, or a third party designated by them who is not the carrier, has received the product.

When an order consists of multiple products delivered separately, the reflection period may begin, in accordance with legal regulations, after the final product has been received.

The consumer can exercise the right of withdrawal by notifying Rosarelia within the reflection period of the intention to withdraw from the agreement. This can be done via email, the statutory model withdrawal form, or the online cancellation/withdrawal function on the webshop, if available.

Returning a product without a clear notification of withdrawal may be insufficient to communicate the withdrawal.

9.2 Handling the product during the reflection period

During the reflection period, the consumer must handle the product and its packaging with care. The consumer may unpack and inspect the product to the extent necessary to establish its nature, characteristics, and functioning, just as would be possible in a physical store.

If the product is damaged or reduced in value through use beyond what was necessary to inspect the product, the consumer may be liable for this loss in value in accordance with legal regulations.

Where reasonably possible, the product should be returned with all supplied parts and accessories.


Article 10 – Exceptions to the right of withdrawal

Not every product falls under the statutory right of withdrawal. The right of withdrawal can only be excluded where permitted by law and the consumer has been clearly informed about the exception before the agreement is concluded.

For Rosarelia, the right of withdrawal can be excluded for, among other things, products that:

  • have been specifically made according to the personal wishes or specifications of the consumer;

  • are clearly personal in nature;

  • or fall under another statutory exception.

An exception to the right of withdrawal is only applied when all legal requirements for that exception have been met.

For products for which a hygienic exception may legally apply, the right of withdrawal may lapse if a seal has been broken after delivery, but only to the extent that the legal conditions for this have been fulfilled.


Article 11 – Returns and refunds

When the consumer exercises the right of withdrawal, the consumer must return the product personally to:

The consumer is personally responsible for shipping the return.

The direct costs of returning a product after exercising the right of withdrawal are for the consumer's account, unless Rosarelia has indicated otherwise in advance or the law provides otherwise.

The consumer is responsible for a correct and timely return. Rosarelia advises sending a return shipment with proof of postage and, if available, a track & trace code.

If a return is received without sufficient information, Rosarelia may not always be able to immediately determine which order the return relates to. This may delay processing.

In the event of a valid withdrawal, Rosarelia will refund all payments received from the consumer, including the costs of the cheapest standard delivery, to the extent required by law.

If the consumer has chosen a more expensive shipping method than the cheapest standard delivery, Rosarelia is not required to refund the difference.

The refund will take place within the statutory term and, in principle, via the same payment method used for the original payment.

Rosarelia may withhold the refund until the returned product is received or until the consumer has demonstrated that the product has been sent back, whichever occurs first.


Article 12 – Canceling orders

A consumer cannot simply cancel an order after it has been confirmed by Rosarelia and its processing or personalization has commenced.

For personalized or custom-made products, cancellation may not be possible after the commencement of personalization or production, to the extent permitted by law.

A discount code cannot be added to an order after it has been placed, unless Rosarelia explicitly agrees to this.


Article 13 – Conformity, defects, and legal warranty

Rosarelia warrants that the supplied products meet the agreement and the legal requirements applicable to them.

A consumer has legal rights when a product does not conform to the agreement. These legal rights are not limited by these general terms and conditions.

In the Netherlands, there is no general fixed legal warranty period that is the same for every product. What a consumer may reasonably expect from a product depends, among other things, on the type of product, the price, the information provided about the product, and the circumstances of use.

If a product is damaged upon receipt or shows another defect, we request that the customer report this to Rosarelia as soon as possible.

For a quick assessment of a complaint, Rosarelia may ask for photos, a description of the problem, and the order number.

If a product has become defective due to misuse, careless handling, normal wear and tear, or other circumstances attributable to the customer, there is no automatic right to free repair or replacement.

Any additional manufacturer or seller warranty is in addition to the consumer's legal rights and does not limit these rights.


Article 14 – Use and maintenance of jewelry

The customer must handle jewelry with care and take into account the nature of the material used.

Specific maintenance or usage advice may apply to each product. If these are mentioned with the product, it is advised to follow them.

With imitation jewelry, contact with water, perfume, lotions, cosmetics, cleaning agents, sweat, and other substances may affect the color, coating, or finish of the jewelry.

Such changes may, depending on the material and circumstances, be normal signs of use or wear and tear.

Normal wear and tear or discoloration resulting from the properties of the material or conditions of use does not automatically mean there is a defect.

The legal rights of the consumer when a product does not conform to the agreement remain fully applicable.


Article 15 – Earrings

Rosarelia sells earrings. Rosarelia does not sell other types of piercings, unless explicitly stated with a product.

Due to the personal and hygienic nature of earrings, a legal exception to the right of withdrawal may apply to certain earrings, for example, when a seal has been broken after delivery and the legal conditions for the exception have been met.

Such an exception is only applied when permitted by law.

It is the customer's responsibility to use earrings in a hygienic and careful manner.

If a customer experiences an allergic reaction or other physical complaint, the wearing of the jewelry in question must be stopped immediately. Rosarelia cannot guarantee that a piece of jewelry is suitable for every person.

The materials used are stated with the product in question insofar as relevant.


Article 16 – Damage and incorrectly delivered products

Rosarelia carefully checks orders before they are shipped.

If a product has been damaged during delivery, we ask the customer to report this to Rosarelia as soon as possible after receipt.

To quickly assess damage, Rosarelia may ask for clear photos of:

  • the damaged product;

  • the packaging;

  • the shipping label;

  • any visible transport damage.

When an incorrect product has been delivered, the customer must report this to Rosarelia as soon as possible.

Rosarelia will then indicate how the product can be returned and will, in the event of an error by Rosarelia, bear the reasonable return costs.

A legal claim by the consumer is not excluded because a report was not made within a period desired by Rosarelia.


Article 17 – Return conditions for jewelry

Returned products must be carefully packaged to prevent damage during transport as much as possible.

The product must, as far as reasonably possible, be returned complete and in the condition in which it was received.

Products that fall under a legal exception to the right of withdrawal cannot be returned based on the right of withdrawal.

For personalized jewelry or other items made especially for the customer, the right of withdrawal may be excluded when this is clearly stated in advance and the legal conditions for this have been met.

For earrings and other products with a hygienic nature, the right of withdrawal can only be excluded when the legal conditions for such an exception have been met.

Returning a product does not automatically mean that every complaint or every form of damage is at Rosarelia's expense. The assessment takes place based on the applicable legal rules and the circumstances of the case.


Article 18 – Complaints

Rosarelia considers it important that complaints are handled carefully.

A complaint can be submitted via:

A complaint preferably includes:

  • the order number;

  • a clear description of the problem;

  • if relevant, photos of the product or the packaging.

Rosarelia attempts to answer complaints as soon as possible and, in consultation with the customer, to reach an appropriate solution.

Submitting a complaint does not automatically suspend payment or other obligations, unless the law or Rosarelia provides otherwise.

When a complaint cannot be resolved in mutual consultation, the legal options of the consumer remain, including submitting the dispute to the competent court.


Article 19 – Liability

Rosarelia is exclusively liable for damages insofar as this can be attributed to Rosarelia according to the law.

Rosarelia is not liable for damages resulting from the use of a product in a manner that does not correspond to the product information, maintenance instructions, or reasonably expected manner of use, insofar as the law permits.

Rosarelia is not liable for damages caused solely by incorrectly provided information by the customer, including an incorrect delivery address or incorrect personalization details.

These provisions do not limit Rosarelia's liability insofar as such a limitation is not permitted by law.

The legal rights of consumers always remain applicable.


Article 20 – Force majeure

Rosarelia is not obliged to fulfill any obligation if it is temporarily or permanently prevented from doing so by circumstances that are reasonably beyond its control.

Such circumstances include, but are not limited to, where relevant: disruptions at carriers, suppliers, or payment providers, serious technical failures, fire, government measures, natural disasters, and other circumstances that could not reasonably have been foreseen or prevented.

When a force majeure situation delays the execution of an order, Rosarelia will inform the customer about this as soon as reasonably possible.

The consumer's legal rights in the event of prolonged or permanent non-delivery remain applicable.


Article 21 – Privacy

Rosarelia processes customer personal data only to the extent necessary for purposes including processing orders, payments, customer service, and complying with legal obligations.

Article 22 – Applicable law and disputes

Dutch law applies to agreements between Rosarelia and consumers, insofar as the law does not provide that mandatory rules of the country where the consumer resides remain applicable.

The Vienna Sales Convention does not apply.

Rosarelia and the customer will first attempt to resolve any dispute through mutual consultation.

If a dispute cannot be resolved mutually, it may be submitted to the competent court, with due observance of the legal rules applicable to consumers.


Article 23 – Amendment of the general terms and conditions

Rosarelia may amend these general terms and conditions when necessary, for example due to changes in laws and regulations or business operations.

For agreements already concluded, in principle, the terms and conditions that were applicable at the time the agreement was formed remain in effect, unless an amendment is legally permitted to apply to that agreement as well.

When Rosarelia begins using new general terms and conditions, these will be made available on the website.


Article 24 – Final provisions

If one or more provisions of these general terms and conditions are found to be invalid or unenforceable, the remaining provisions will remain in force.

An invalid or unenforceable provision will, to the extent legally possible, be replaced by a legally valid provision that corresponds as closely as possible to the intent of the original provision.

These general terms and conditions have been prepared for Rosarelia and are intended solely for use by Rosarelia.
